Rettssikkerheten i Thailand
Som i mange land med liten utdannlseArild Holtet skrev: ↑31 jan 2018, 02:02 Må si at jeg har minimal tro på rettsystemet i Thailand. Har sett hva som har skjedd eller mer ikke skjedd i voldtektssaker, der politiet prøver å skyve skylda over på fattige fremedarbeidere. Folk med penger og posisjon MÅ skånes, selv om de har beggått mor. Men uansett så blir det spennende å se utfallet av denne saken.

Lite ja ikno jus!
Påtale myndighter som får inn mistenkte
Er overarbeida! Og « mistenkte» blir ofte
Sittende altforlenge!
Det er viktig og vite ( selvom praksis
kan sprike) at også i thailand skal en oppi
Forhørsrett innen 48 timer!
Men har en ikke en god advokat
På hand er det
Desverre slik at mistenkte blir sittene!
Og da må man bevise at en er uskyldig!
Ikke samme rettspraksis og politi/påtale
Myndighet som i norge!
Selv der kan en bli sittende i varetekt
Lenge! Vel forhørsrett lener seg ofte til
mistanke!
Driver en litt på kanten vel , ha telefon nr
Til en annerkjent advokat!
Slik er det i mange land!
Desverre blir uskyldige dømt over alt
I verden! Ofte pga at påtalemyndighet
Er overarbeida og ikke kan jus!

Rights of an Alleged Offender in Criminal Cases during Investigation Stage
Police officers have the right to keep an alleged offender for investigation for 48 hours. In case the investigation is not finished within 48 hours, the investigating police officer must obtain a court order granting confinement time extension. The period of extension of confinement is at the court’s discretion.
During the 48 hours of the investigation stage, the alleged offender has the rights as follows:
– be informed of charges brought against him by the arresting officer. They must show the arrest warrant (if issued) to the arrested.
– remain silent or testify any facts.
– inform his embassy, relatives or any people of his arrest and the place of his incarceration.
– privately consult with his lawyer by making a written or verbal request to the police officer on duty for meeting his lawyer at the police station. The court can provide a lawyer without any cost for an alleged offender who cannot afford one.
– have an interpreter (for non-Thai speaker) provided by the police or the court for translation during the legal procedures.
– have a lawyer present at every step during the investigation.
– receive visitation (if incarcerated) during business hours or at any time allowed by the police officer on duty.
– receive proper medical treatment, if sick. Police officers will provide an escort going to a government hospital before confinement and after receiving permission from the police station chief.
– apply and to post bail request form to the investigating officer and they will review the bail request without delay.

Mitt inntrykk etter å ha lest artikkelen er at det fornuftige nok er å gi slipp på strafferettslig forfølgelse og heller gjøre noe i datterens minne. Feks info kampanje rettet nettopp mot sikkerhet ved dykking. På en eller annen måte få ro i sjelen. Å prøve med rettsaker virker å være det stikk motsatte. Det som er skjedd er skjedd og de har vel rimelig god klarhet i omstendighetene og hvem som var involvert.

Og myndighetene er ikke til noe hjelp, men de lar denne kriminelle advokaten drive med sitt scamopplegg ettersom papirene er i orden....40% av denne scamen gikk vel rett i lomma til en eller annen kan det tenkes...skatt kaller de vel det..Eller som det ble skrevet i en link i en annen post, det kalles ikke korrupsjon men buisness...honor doesnt pay..
